GENERAL TERMS OF USE — BOOSTILLICO

1. Purpose
These general terms of use ("Terms of Use") govern access to the platform https://boostillico.boostvitrine.fr (the "Platform"), published by Gwenaelle Papin EI (Boost Vitrine) (the "Publisher"). It allows you to choose a showcase website template, customise it, preview it and order it. Orders are governed by the general terms and conditions of sale ("GTCS").
2. Users
The Platform is intended for professionals (businesses, self-employed individuals, liberal professions and associations) acting for the purposes of their business activity.
3. Account
3.1. Creating an account is free of charge. It requires a valid e-mail address, which must be confirmed before access to the full catalogue and the configurator is granted.
3.2. The user chooses a password of at least 12 characters and keeps it confidential. Any action carried out from their account is deemed to have been carried out by them.
3.3. The user may request the deletion of their account at contact.boostillico@boostvitrine.fr. Data relating to orders is retained for the legally required periods.
3.4. When the account is created, the user is assigned a personal referral code; its conditions (benefits and commissions) are set out in Article 8.3 of the Terms of Sale.
4. Rules of use
The user undertakes to provide accurate information, not to upload malicious files or unlawful content, not to infringe the rights of third parties, and not to circumvent security measures or usage limits, in particular the rule of one ongoing project per account.
5. Uploaded content
The user remains the owner of the texts and images they upload. They warrant that they hold the necessary rights and authorise the Publisher to store and process them for the sole purpose of generating their website. Projects that have not been ordered and are inactive are deleted after 30 days, together with their images.
6. Previews
Previews are private, temporary (24 hours, renewable) and excluded from search engines. They do not constitute publication online.
7. Assistant and messages
The Platform assistant (“A question?”) provides answers generated by artificial intelligence from the Publisher’s information; they may contain errors and replace neither the Terms of Sale nor professional advice. The “Write to the team” button lets the user send a message to the Publisher, who replies by e-mail; the user undertakes not to use it to send advertising, abusive or unlawful messages. The number of questions and messages is limited in order to preserve the service.
8. Availability
The Publisher endeavours to ensure access to the Platform without guaranteeing continuous availability. Interruptions for maintenance may occur.
9. Suspension
In the event of a breach of the Terms of Use, the Publisher may suspend or close the account concerned, after informing the user, except in cases of urgency or legal obligation.
10. Intellectual property
The Platform, the templates, the Boost CMS software, the texts and the Publisher's trademarks are protected. Any unauthorised reproduction is prohibited, subject to the rights granted to the customer under the GTCS.
11. Liability
The Publisher is not liable for the content uploaded by users, nor for the use they make of the generated websites. The Publisher provides no maintenance of the generated sites: once paid for and delivered, they become the property of the customers, who alone, or through the provider of their choice, are responsible for their hosting, maintenance, updates and security (see the Terms of Sale, Articles 3.6, 10.4 and 15).

13. Amendment of the Terms of Use
The Publisher may amend the Terms of Use. The new version is brought to the attention of users and applies from the date it is published online. Orders remain governed by the GTCS accepted at the time they were confirmed.
14. Applicable law
The Terms of Use are governed by French law.
